Terms of Service

By accessing or using StayVia's platform, website, or mobile applications (collectively, the "Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Platform. These Terms constitute a legally binding agreement between you and StayVia Limited ("StayVia," "we," "us," or "our"). We may update these Terms from time to time, and your continued use of the Platform constitutes acceptance of any changes.

To use StayVia, you must: • Be at least 18 years of age • Have the legal capacity to enter into binding contracts • Not be prohibited from using our services under applicable laws • Provide accurate and complete registration information By using our Platform, you represent and warrant that you meet all eligibility requirements.

To access certain features of our Platform, you must create an account. When registering: • You agree to provide accurate, current, and complete information • You are responsible for maintaining the confidentiality of your account credentials • You agree to notify us immediately of any unauthorized access to your account • You are responsible for all activities that occur under your account We reserve the right to suspend or terminate accounts that violate these Terms or engage in fraudulent activity.

StayVia provides an online platform that connects guests seeking accommodation with hosts offering properties for short-term rental. We act as an intermediary and: • Do not own, manage, or control the properties listed on our Platform • Are not a party to any rental agreement between guests and hosts • Do not guarantee the quality, safety, or legality of any listing • Are not responsible for the conduct of any user Our role is limited to facilitating connections and processing payments between users.

When you make a booking through StayVia: • You agree to pay the total amount shown at checkout, including the accommodation fee, service fees, and any applicable taxes • Payment is processed at the time of booking • Cancellations and refunds are subject to the host's cancellation policy and our Refund Policy • We may charge a non-refundable service fee Hosts receive payment 24 hours after guest check-in, minus our service fee. Payment terms may vary based on booking type and host preferences.

If you list a property on StayVia, you agree to: • Provide accurate and complete information about your property • Maintain your property in a safe and habitable condition • Comply with all applicable laws, regulations, and tax requirements • Honor confirmed bookings unless cancellation is permitted under our policies • Respond to guest inquiries in a timely manner • Obtain all necessary permits, licenses, and insurance for your property Hosts are solely responsible for ensuring their listings comply with local laws and regulations.

As a guest using StayVia, you agree to: • Treat the host's property with respect and care • Follow the host's house rules and checkout procedures • Not exceed the maximum occupancy stated in the listing • Report any damages or issues promptly • Not engage in illegal activities on the premises • Vacate the property by the agreed checkout time Guests may be held financially responsible for any damages caused during their stay.

Users of StayVia must not: • Violate any applicable laws or regulations • Post false, misleading, or fraudulent content • Discriminate against other users based on protected characteristics • Harass, threaten, or abuse other users • Use the Platform for commercial purposes outside normal hosting • Attempt to circumvent our payment system • Scrape, copy, or harvest user data without permission • Upload malicious software or engage in activities that could harm the Platform Violation of these prohibitions may result in immediate account termination.

All content on the StayVia Platform, including logos, designs, text, graphics, and software, is the property of StayVia or its licensors and is protected by intellectual property laws. Users retain ownership of content they submit but grant StayVia a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display such content for Platform operations and marketing purposes.

THE STAYVIA PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not guarantee: • The availability, accuracy, or reliability of the Platform • That listings meet your expectations • That the Platform will be error-free or uninterrupted • The conduct or reliability of any user

TO THE MAXIMUM EXTENT PERMITTED BY LAW, STAYVIA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE PLATFORM. Our total liability for any claims arising from these Terms or your use of the Platform shall not exceed the greater of: • The amount you paid to StayVia in the 12 months preceding the claim, or • ₦50,000 NGN

You agree to indemnify and hold harmless StayVia, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: • Your use of the Platform • Your violation of these Terms • Your violation of any third-party rights • Content you submit to the Platform

Any disputes arising from these Terms or your use of the Platform shall be: • First, attempted to be resolved through good-faith negotiation • If negotiation fails, submitted to binding arbitration in Lagos, Nigeria • Governed by the laws of the Federal Republic of Nigeria You agree to waive any right to participate in class action lawsuits against StayVia.

We may terminate or suspend your account at any time for any reason, including: • Violation of these Terms • Fraudulent or illegal activity • Extended inactivity • At our sole discretion Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination shall remain in effect.
